1. Acceptance of Terms

By accessing or using Dripkit ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including those on free and paid plans. By creating an account, you confirm you are at least 16 years old and have authority to enter into this agreement.

2. Description of Service

Dripkit is an AI-powered email marketing platform that helps small businesses create, schedule, and send email campaigns. The Service includes:

• AI-generated email campaign writing
• Drip sequence automation
• Subscriber list management
• Email delivery via Resend
• Campaign analytics and reporting
• Autopilot mode (Pro plan)

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of unauthorized access

We reserve the right to terminate accounts that contain false or misleading information.

4. Free Plan and Paid Plans

Free Plan

The free plan is available to all users at no charge and includes limited features as described on our pricing page. No credit card is required.

Pro Plan

Pro plan subscriptions are billed monthly at the current advertised rate. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation and Refunds

You may cancel your Pro subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not provide refunds for partial billing periods except where required by law.

Plan Changes

We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree to use Dripkit only for lawful purposes. You must not use the Service to:

• Send unsolicited commercial email ("spam") to contacts who have not opted in
• Violate CAN-SPAM, GDPR, CASL, or any other applicable anti-spam or privacy law
• Send emails containing illegal content, malware, or phishing attempts
• Promote illegal activities, violence, or discrimination
• Harvest email addresses without consent
• Circumvent unsubscribe requests
• Impersonate any person or organization
• Overload, attack, or disrupt the Service infrastructure
• Attempt to gain unauthorized access to other accounts

Email List Requirements

By uploading a subscriber list or collecting emails through Dripkit, you confirm that:

• All contacts have given explicit consent to receive marketing emails from you
• You maintain records of consent as required by applicable law
• Your list was not purchased, rented, or scraped without consent

6. Content and Intellectual Property

Your content

You retain ownership of your subscriber data, business information, and any content you create using Dripkit. You grant us a limited license to process this content solely to provide the Service.

AI-generated content

Campaign drafts and copy generated by Dripkit's AI are provided for your use. You are responsible for reviewing, editing, and approving all content before sending. We do not guarantee the accuracy, originality, or legal compliance of AI-generated content.

Our intellectual property

The Dripkit platform, including its software, design, and documentation, is owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute the platform without permission.

7. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to our Privacy Policy.

8. CAN-SPAM Compliance

All campaigns sent through Dripkit must comply with the CAN-SPAM Act and equivalent laws in your jurisdiction. This means:

• Including a physical mailing address in your emails
• Honoring unsubscribe requests within 10 business days
• Not using deceptive subject lines or sender information
• Clearly identifying messages as advertising where required

Dripkit processes unsubscribe requests automatically. You must not suppress or override these requests.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• AI-generated content will meet your specific requirements
• Email campaigns will achieve any particular open rate, click rate, or revenue outcome
• The Service will be free from security vulnerabilities

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIPKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Dripkit and its affiliates, officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your email campaigns and subscriber communications
• Your violation of any third-party rights

12. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms. Upon termination:

• Your access to the Service will cease immediately
• We will retain a copy of your data for 30 days, after which it will be deleted
• You may request a data export before termination takes effect

You may close your account at any time through account settings.

13. Modifications to Terms

We may update these Terms at any time. We will provide at least 30 days' notice for material changes by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for intellectual property violations.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dripkit regarding the Service. They supersede any prior agreements or understandings.
